Make those calls and write those letters!!!! We absolutely must do something about this!!! The judge has some things to answer to in this case!!!! Think about all the victories the animals have seen these recent years. Now think about them being for nothing. A judge, a man sworn to serve justice, is trying to do just that. He has allowed Michael T. Welch to "walk" after brutally torturing and beating to death Dusty, an adopted shelter dog. Welch savagely beat Dusty with a baseball bat and sledge hammer. He admitted to taking a few beer breaks during the torture. The sledge hammer delivered the fatal blow. How can animal rights ever advance when judges are putting us back 20 years? Law enforcement made sure the case made it to the courts. Welch confessed to his crime. Should have been open and shut so what happened with the judge? What was Welch's punishment? No jail time, no fine, and if he is a "good boy" for the next 3 years it won't even show on his record!!! CRIMES AND PUNISHMENT; PEACE OFFICERS AND PUBLIC DEFENDERS CHAPTER 578. MISCELLANEOUS OFFENSES 578.009. Animal neglect--penalties 1. A person is guilty of animal neglect when he has custody or ownership or both of an animal and fails to provide adequate care or adequate control, including, but not limited to, knowingly abandoning an animal in any place without making provisions for its adequate care which results in substantial harm to the animal. 2. Animal neglect is a class C misdemeanor upon first conviction and for each offense, punishable by imprisonment or a fine not to exceed five hundred dollars, or both, and a class B misdemeanor punishable by imprisonment or a fine not to exceed one thousand dollars, or both upon the second and all subsequent convictions. All fines and penalties for a first conviction of animal neglect may be waived by the court provided that the person found guilty of animal neglect shows that adequate, permanent remedies for the neglect have been made. Reasonable costs incurred for the care and maintenance of neglected animals may not be waived. 578.012. Animal abuse--penalties 1. A person is guilty of animal abuse when a person: (1) Intentionally or purposely kills an animal in any manner not allowed by or expressly exempted from the provisions of sections 578.005 to 578.023 and 273.030, RSMo: (2) Purposely or intentionally causes injury or suffering to an animal; or (3) Having ownership or custody of an animal knowingly fails to provide adequate care or adequate control. 2. Animal abuse is a class A misdemeanor, unless the defendant has previously plead guilty to or has been found guilty of animal abuse or the suffering involved in subdivision (2) of subsection 1 of this section is the result of torture and mutilation consciously inflicted while the animal was alive, in which case it is a class D felony. 3. For purposes of this section, "animal" shall be defined as a mammal. In a message dated 4/24/03 1:19:46 PM Central Daylight Time, PLEASE CROSS-POST WIDELY Dusty is a shelter dog who had had a rough beginning in life. When he was finally adopted, shelter workers were very happy that he was getting a chance at a good life. But Dusty was adopted by the wrong family. He was tied up and beaten for more than 3 hours with a baseball bat and finally finished off with a sledghammer. His owner, Mr. Welch admitted taking beer breaks during the hours of abuse. Local law enforcement was responsible enough to see that the case got to the prosecutor's office. So what happened? Judge Preston Dean of Kansas City reviewed the case, including Welch's confession and decided that the punishment would be: no jail time no fine If Welch is a "good Boy", this torture and abuse will not even show up on his record. Obviously, with judges like this, our police and prosecutors will think, "why bother to prosecute animal cases at all." In fact, that's the way it is in many areas of Missouri - a state infamous for its backwardness in animal welfare matters.
