There have been several court cases, articles >and even some books taking one or the other side. My family and family friends seem to be divided on this one. Most argues that Kayasthas were part of the Ksatriya varna, while others did mention that some scholars felt that they came from the Sudra varna. What did the above court cases argue? Also, the fact that people in India had thought about such a thing does give some counter argument to your idea that the varna system is not really present in modern India.
