Guest guest Posted August 18, 2005 Report Share Posted August 18, 2005 HC posts temple case hearing against Seer to Aug 25 Chennai, Aug 17 : Madras High Court today posted to August 25 hearing on a petition, seeking to vacate the stay on the operation of the order directing the police to register a case against Kanchi Seer Jayendrasaraswathi and four others in connection with the alleged destruction of a sub temple of Lord Shiva in the Azhagiya Nambirayar Perumal Temple in Tirunelveli District of Tamil Nadu. A division bench comprising Chief Justice Markandey Katju and Justice A Kulasekaran posted to August 25, the hearing on the petition filed by Mr Krishnamachari, Secretary, ''Divya Desa Paramburiya Paudhukappu Peravai'' and directed the Registry to post all the connected cases pertaining to this issue pending before the Madurai Bench of Madras High Court to this court. When the case came up for hearing, Senior Counsel K Parasaran, appearing for Venu Srinivasan, a Trustee of Srinivasa Charitable Trust, submitted that a single judge passed the order without giving an opportunity to the other side. Moreover, a committee appointed by the State Government ratified the removal of the sub temple. On the same issue, six writ petitions and a civil suit was pending before the Madurai Bench. Hence they may be posted here and all the cases may be clubbed together and be heard and a comprehensive order could be passed, he added. Expressing no objection for clubbing all the related cases, Senior Counsel V Prakash, appearing for the Peravai said clubbing of cases would not affect the criminal prosecution. Following this, the bench gave the above direction and posted the matter to August 25 for final disposal. Originally, Mr Justice P D Dinakaran had directed the police to register a case against the seer, Srinivasa Charitable Trust represented by its Trustee Mr Venu Srinivasan, Jeer Mutt represented by Perarulala Ramanuja Jeeyar, Sri Vanamamalai Mutt represented by Srinath Kaliyan Vanamamalai Ramanuja Jeer and Unni Krishnan Panickar, a Josier of Kerala while allowing a petition from the Peravai. A division bench headed by Chief Justice Markandey Katju had on June 24 stayed the operation of a single judge's order on an appeal filed by Mr Venu Srinivasan.
