US-based organisation condemns party-Maoist understanding Nepali Nationalist Organization (NNO) – an organisation of the Nepalis in the US—has condemned the recently concluded pact between the CPN (Maoist) and the seven party opposition alliance saying that it took place as per the instruction of foreign hands to further destabilize the beautiful nation. In a statement issued by Bishal Shah, president of the little-known organsiation, has asked all patriots to remain alert to reject and fight against what he called `anti-national criminal elements.' "It is not just the duty of our brave security personnel to defend the nation rather the responsibility also falls upon the shoulders of all the patriots," the statement said. NNO has urged the international community including the US, the EU, China and all Hindu and Buddhist friends of India, to extend their friendly hands to fight what it called the Bin Laden of Nepal. NNO has also called upon all patriots to make national elections successful by exercising the invaluable rights to choose their representatives for the future of Nepal. The statement by the NNO has come less than 24 hours after major and reputed organizations of the Nepalis based in the US welcomed the understanding reached between the seven party opposition alliance and the Maoists to restore peace and democracy in the country. The incident took place at Umragaon, Ward no-3 of the VDC as the children were playing with a bag left unattended by the Maoists. The bag carried nine sutali bombs and all of them exploded, according to the District Police Office, Dhanusa. The children injured in the incident are six-year-old Rajaram Yadav and four years old Sanjaya Yadav, sons of Indal Yadav and two other children of the same locality. It is also against the existing laws of the country, they said. The so-called equation was totally against the norms and spirit of the Constitution of 1990 and the then governments of the political parties had declared them terrorists and had also issued red-corner notices against their so-called leaders, they said. Talking to The Rising Nepal senior advocate Kunja Bihari Prasad Singh said that no citizen has right to hatch conspiracy against the nation in the foreign land and the terrorists are constitutionally excluded and denied of the state mechanism by all countries around the world. "Terrorists do not come under the definition of citizen of a nation and they have no legitimacy in taking decisions related to the country. Hence, talking and making alliance with them is also unlawful." Advocate Chandra Kafle said that the so-called equation between the terrorists and the political parties as reported by some media was against Article 42 of Vienna Convention on Diplomatic Relation, where a diplomat should not interfere the internal affairs of the receiving nation, except promoting friendly relations between them. It was a sort of foreign interference in the internal politics, he said. "Those diplomats, who use their diplomatic immunities, should respect the laws and regulation of the nation, where they serve as diplomats." The agreement between the parties and terrorists would be harmful for the restoration of peace in the country, he said and added that the political parties were trusted by the people under the Constitution of 1990, which advocates constitutional monarchy and multiparty democracy. "The acts of political parties have created a sort of anomaly and crisis in the nation by adding fuel to the present conflict." Advocate Ram Prasad Pandit also said that the so-called alliance between political parties and the Maoists was against the norms and sprit of our constitution, against international convention against terrorists and humanitarian laws practised around the world. "It is an unnatural equation and what the seven political did was abnormal." Advocate Hari Shankar Niraula said that contribution to peace might not be objectionable but all those endeavours should have legitimacy under the prevailing law of the land. Any equation in the absence of the state's involvement cannot become effective. "Any way out of the present crisis should be searched within the parameter of the present constitution." The so-called equation is impractical and against the existing laws and practices in the nation and the seven political parties, which found legitimacy under the Constitution of 1990, will lose their legitimacy if they turn their faces away from it, he said. http://www.gorkhapatra.org.np/pageloader.php? file=2005/11/26/topstories/main4 It will lead to regression By Our Correspondent KATHMANDU, Nov. 25: The agreement between seven political parties and the Maoist would lead the country towards a regressive path and would harm the country in the long run, said Bhuvan Pathak of the Rastriya Prajatantra Party. He said that this sort of agreement or understanding should be done at the state's level and only then it would get legitimacy. "The agreement between the seven parties and the Maoists was against the constitution," he said. In the absence of the state party, such an agreement was valueless, he further said. He said that it was a paradox that the two parties, Nepali Congress and CPN-UML, which were involved in formulating the present constitution, were engaged in repealing the constitution by forging alliance with the ones which had dissented the constitution. "Their agreement with the Maoists will further bruise the constitution and multi-party democracy." It was not a good signal, he added. Pathak said that their agreement does not include cease-fire and also laying down arms by the rebels, the two important points to restore peace in the country. "The parties have also failed to take into consideration the people, who were killed by the Maoists, and compensation for infrastructure that were destroyed by the Maoists while entering into agreement." Pathak said that the agreement would affect the peace process and would push the country into further anarchy. Furthermore, he said it was a shame that the political parties agreed to keep an institution like the Royal Nepalese Army at par with the armed rebels and to give a nod to keep the RNA under the UN. He said that election was the heart of democracy and instead of strengthening the constitution by participating in the election they are going against the constitution. This has revealed their true character and this would seriously mar their image before the people.
