Though he had power and was commissioned by God to discriminate in between matter and spirit. In our terms, he primarily was situated in sudha sattva. Than he willingly felt to lower modes. His fault was he kept silent, what the Snake spoke. He should reject the Snake teaching and explain the teaching of God, which he knew. In spite Eve first try to defend God, but she was finally confused by the snake. So this nondiscrimination in between reality and illusion is the so called our heritable sin, at least by the Bible.
