The two sons of Kuvera Nala Kuvera and Manigriva were intoxicated when they appeared naked before Narada Muni. Both were held responsible and cursed to become trees. It would depend on the position of the intoxicated person. If he/she should know better then it wouldn't be an excuse. In any case we are responsible for what we do and knowingly if one consumes intoxications they are still responsible for what they do. Lord Sri Krishna Caitanya Mahaprabhu didn't take offense when a drunk man chanted and danced mimicking Him, but said the drunks intoxication would wear off within 24 hours, but the benefit of chanting the Holy names would remain with him forever.
