The Cabinet also decided to grant dual citizenship to people of Indian origin living in eight countries and also approved the enactment of a Central law for the prohibition of cow slaughter under Article 252 (1) of the Constitution to overcome the problem of the legislative competence of the Centre. Parliamentary affairs minister Sushma Swaraj said Article 252 (1) allows the Centre to draft a legislation for states if two or more state governments pass a resolution in their Assemblies for such a law. Ms Swaraj said the Centre cannot make the law on its own as it was not competent to draft such legislation. To overcome the problem of legislative competence, the Centre has asked the animal husbandry department to write to all the state governments to send their proposals for such a legislation. Ms Swaraj said though many states already have legislation against cow slaughter, it is not followed as in most laws there is no ban on killing old cows. The Centre proposes to bring a comprehensive legislation to ban the killing of cows, irrespective of their age. To check illegal immigration from across the border in Assam, the Union Cabinet decided to repeal the contentious Illegal Migrants (Determination by Tribunals) Act, 1983. This will enable the government to accelerate the detection and deportation of migrants who have entered Assam on or after March 25, 1971. The minister said the cabinet approved a draft bill to repeal the IMDT Act from a date to be notified and that the repealing measure would be introduced during the current session of Parliament. Ms Swaraj told reporters that the national judicial commission will be headed by the Chief Justice of India and its members will include the two seniormost judges of the Supreme Court, the Union law and justice minister and an eminent citizen nominated by the President on the advice of the Prime Minister. The commission will have a three-year term and its main function will be to recommend the appointment of judges and the transfer of judges. The commission is being set up by amending Articles 124 (2), 217 (1), 222 and 231 of the Constitution pertaining to the appointment of judges. The Cabinet also gave its assent to inserting a new chapter, 4 (a), in Part 5 of the Constitution. Ms Swaraj said the dual citizenship move is as per the promise made to people of Indian origin at the NRI festival held in New Delhi earlier this year. Dual citizenship has been granted to people living in eight countries — Australia, the US, the UK, Italy, Netherlands, Ireland, Finland and Canada. Those interested in dual citizenship would have to apply for it. After the application is accepted, they will enjoy all the rights of an Indian citizen, except three — they will not have voting rights, they will not be allowed to take any constitutional position, and they can not apply for jobs in the armed forces.
