Guest guest Posted September 30, 2009 Report Share Posted September 30, 2009 Dear Ruchika,Hon'ble High Court may give relief and release the accused on bail on depositing half of the amount to the court of Magistrate or on sureties only.But accused will have to deposit the entire amount of cheque and fine and further sentence may be converted in to fine also if prayed in this regard.If the appeal is cotested on merit,the Hon'ble High court will surely dismiss the appeal.There is no other course open for convict u/s 138 N.I Act. We have to guide by astrological way when and what would be the best period for herself to try for bail in appropriatge courts.
