Although the ability to judge is present in all beings, nevertheless, the discrimination between truth and untruth, between duties and things not to be done, are only in human beings. This ability to discriminate, is useful in all situations and circumstances, whether in relating with others, or in spiritual matters, whether it be in this world or in the world beyond. Therefore in the Srimad Bhagavadgita, the Lord's very first discourse is on discerning between real - unreal, body and the dweller in this body (Gita 2:11- 30). But those beings whose intellect is not sharp and who are lacking in detachment from worldly desires, for such individuals it is difficult to understand the difference between truth and untruth, real and unreal. Therefore for such individuals, God has spoken on rightful duties and that which is non-dutiful (Gita 2:31/38). He has inspired such human beings to give up wrongful actions and to follow that which is prescribed by the scriptures. Because the essence that is attained by giving importance to the discrimination between real and unreal, can also be attained by through dutiful actions, rather by doing one's own duties. Doing one's duties with a selfless attitude, according to one's class and stage in life etc is called " Swadharma " one's own religion or personal duty. The sanctions of religious and moral laws and our own duties, is one and the same. According to the situations and circumstances, those duties that come one's way, to fulfill them is man's religious and social obligation. Just like a student's duty is to promptly and intently learn and acquire knowledge. In that which there is intention of harming or lack of belief or reverence for another, such actions as in stealing, hurting others etc are no one's duties.
