Trepke http://www..com Grassroots Network Message 311036 MN family sues over home birth Dear Friends, Even though it is not against any state law for a mother to give birth at home, families are still vulnerable when child protection services get involved. While a complaint is made of suspicion of child abuse or neglect, child protection services are authorized to act first, ask questions later. In this story the parents already had eight children, and several of them were born at home, so they were experienced with childbirth. The mother attempted to reach a hospital-based lactation consultant as she had concerns that the otherwise healthy baby was not feeding (presumably breastfeeding). When the staff learned the baby had been born at home, social services and the police were involved. There was an allegedly " forced " trip to the hospital, and police attempted to take the newborn to a " home " for children, even though hospital doctors found nothing wrong with the baby. The parents are suing Hennepin County and Minneapolis police on the basis of " unreasonable seizure of a person " since authorities attempted to take the newborn " without a court order or compelling state interest. " They hope to " stop child protection workers from taking children from their home without a court order. However, we have all heard medical professionals label home birth as " child abuse, " and child protection agencies in a number of states in recent years have had to contend with high profile tragedies where their agencies failed to protect children from harm and even death. Unfortunately, the over-zealous use of child protection services powers remains a small but significant risk for home birth families, especially for unassisted births or births attended by unlicensed midwives. The outcome of this case will be of great interest, since the only real reason that child protection services were called in was because the birth took place at home.
