Reading the letter from Medsafe to Celestial it seems this regulation has also been in force in New Zealand since 1981. I put a link in the Links section of our home page to the UK's Borderline products which gives stringent details of how a product can be advertised. In APPENDIX 1 of the document " Guidance notes 8 : What is a Medicinal Product? " words and phrases that would be concidered as making a medicinal claim (under UK law) are listed. These include many seemingly innocent statements that I see regularly on both published and Internet literature. Think here of words like; Traditionally used for; Combats; Help/help with; Is said to help with; etc....... I think what is happening is a general *tightening up* on complementary and alternative therapies throughout the world. Gangsters . & *ssholes, however having listerned to the Rep from Medsafe maybe they are not so bad. I have always used terms such as " May assist... May provide ... no direct claim, this seems to be satisfactory. I'd be interested to hear what others do in other parts of the world. Of course many of us are aware of the incredible claims made by Young Living over the years now that would give the TGA and Medsafe something to worry about. Guest guest Posted March 6, 2008 Report Share Posted March 6, 2008 These regulations in NZ are very similar to the ones in the UK and the fact they were introduced in the same year is not coincidence. The majority of UK oil suppliers have complied with those regulations by not putting medicinal claims on promotional materials. We do however have a few cowboys who have continued doing this and to date have not been prosecuted, that is despite several efforts to get our incompetent MHRA to take action as it is unfair trading. In New Zealand several suppliers promote unjustified claims based on their awful aromatherapy education. I know this because of reports from students who have told me what they were taught. So because of that, I am not surprised that some Civil Servant has started poking around to find out what claims are being made. My guess is several other suppliers will get such cease notices. There seems to be a slight difference in regards the spoken word part of the NZ regulations. Here no one has prevented suppliers from speaking about the properties of their oils. It is also OK here for someone like myself who does not supply the oils to speak about their medicinal properties and to write about them. Unfortunately certain aromatherapy suppliers are bringing down the wrath of the authorities on everyone. Many, particularly in the USA and Canada, make the most outrageous, dangerous & illegal claims. Many make claims of therapeutic efficacy without a shed of evidence. A few also make misleading claims such as " the Atlanteans used essential oils " . If such a race existed, there is NO documentary or verbal evidence to support such a statement,therefore it is misleading and probably false. Others claim essential oils have been used for thousands of years which is not true, or at least not as the distilled oils we now use. This is all due to the perils of people who start up small businesses with no sound training on what they are using, think they can say what they like, and who never bother to check on things such as legislation and other issues applicable to what they are doing. Aromatherapy is packed to bursting with small time suppliers; even those who do take aromatherapy courses are often taught by teachers who know little of such matters themselves. I have been warning for goodness knows how many years what would happen if this trade does not act more responsibly. Now we are under pressure from every angle from people who will attack complementary medicine every way they can. I sure don't like it, but boy do many in these trades deserve it!
