This is NOT regulated by the FDA. I live in Texas and there are no licensing regulations for cosmetics manufacture here. The person I talked to in our state health department's licensing division said that if a complaint were filed, the health department reserves the right to inspect your facility for cleanliness but it's ok for the facility to be a home kitchen. The other list member was also going to check with her county health and city health departments because she lives in a very populated area. My county has no such regs and I'm outside city limits. BTW ... this has no bearing on how you must label your products. HTH ...
