more on sales tax

Gateway computer does...

 

I was checking the invoice on a new system we just bought... I selected,

and was charged for, 2nd day air...it was shipped ground...

 

and to add insult to injury, I was charged sales tax on the shipping...

 

I called the state dept of revenue...NO shipping should not have been

charged... called Gateway, and was told " we charge sales tax on the whole

amount " ... I told them what state law says...was told I'd need to talk to a

superviser... he was, of course, unavailable... and I didn't get the

return phone call I was promised.

 

(this was after calling customer service, being told I needed to talk to

someone in sales, being transfered to sales, and being told I needed to

talk to customer service...sigh...)

 

I'll start the battle again tomorrow !

This was a point I attempted to make and now I know I wasn't clear!

LOL (Nothing new for me.) Sears charges a tax on delivery for the

same reason as Gateway. Called the Department of Revenue and was

told that was legal, however, Gateway, Sears, etc. must then remit

that tax to the taxing authority. I also had this happen with a

sales tax on a labor charge for a shed. I had to pay the contractor,

who assembled it, outside the taxing area in which it was purchased.

After many calls, I was told that it was legal to charge a tax on the

LABOR, mind you, as it was considered a part of the total product!

did you check the state laws in the state it was purchased or your own? this

would be of help to me on the YL adding the shipping charges and then taxing..

The state where the product is delivered is the state which is

collecting the sales tax. When I was in YL, they were only charging

state sales tax on total invoice! When I was in Amway/Quixstar, they

charged state and city sales tax on total invoice. The destination

city and state is the determining factor. Gateway would be added as

a corporation. I do know that here in the greater Denver area,

Gateway has stores so it's no different from making the purchase at

the store or from their corporate selling point, they are still

required to collect and remit the tax.

 

2 of the above are MLM's without storefronts in your state, and 1 is

a corporation with storefronts in many states. Corporations are not

going to be able to sell in any state without be licensed by the

taxing authority. The taxing authority in each state gives the

corporation the taxing information,i.e. what is taxed, which the

corporation is required to collect and remit to each state. The

point of purchase makes no difference in these cases.

 

Did I help here or did I confuse the issue further? I only want to

help you understand.

LOL...nope, I'm totally confused... I live in MO ... and YL is in Utah...so you

mean that they figure out the shipping charges from Utal to MO ... add the

shipping charges to my invoice and the can tax me on the whole thing? I just

don't understand how anyone can charge tax on shipping? I've never had anyone

else do this - guess that's why it surprised me so much.

 

oh well...doesn't matter...I don't order/sell for them anymore :-)

Well dear let me try to explain in less complicated terms. The government

started taxes without asking us or our ancestors. Along the way they got to

thinking they had the right to take from us everything they could. Now they are

doing it. And when they give us a pittance back, whether it be Income Tax, SS or

whatever, they act like it is THEIR money, not ours and that they are doing us a

favor.

well, I understand that totally :-) ... it's just the tax on SHIPPING that I

don't agree with...well, really I don't agree with taxes in general - but them

charging taxes on SHIPPING charges and getting it themselves..well, that just

seemed abit illegal... oh well...

It is only illegal if you are not greasing the right palms. When they start

taxing the air we breathe I will quit breathing.
