Don't know what the laws are in Canada or the UK... but in the US a company can use a trademarked name IF there is no overlap in what they do. ie, there was a Nature's Gift orange juice before I started this business...they don't compete and there's no danger of confusion among our respective markets. the company selling 'nature's gift rose cream' on the other hand ... it's an MSM cream, " designed to be used only as a solvent' says the lable. who ever heard of a solvent CREAM with rose in it? they are on very iffy ground, but I don't have the $$$ to go after them for trademark infringement.
