insurance co's require tax id# for subforms?

i have a couple of patients recently telling me their insurance company is

requiring my tax id # to pay them on a subform. the patients have paid me

at time of service, and are trying to get reimbursed by their insurance

companies. the insurance company is sending payment to the patient, not me,

so i see no reason to give my ss#. i have provided an NPI#. the ss number

was provided in the application process for the NPI#. also, i had thought

it was now illegal for the insur co's to require my tax id#, now that the

NPI# are being used.

 

i am reluctant to provide my ss# for privacy and security issues.

 

does anyone have info on this issue?

Kath:  I would apply for a Tax ID from IRS.  It also requires your Social

Security to apply.  It is a fairly quick process.

 

 

 

1. A Tax ID # - this is so they can see you are a business, even if a sole

proprietor.  You can go on line to IRS and find form

 

SS-4 Application for Employer Identification Number.  You may have to fax it in

and of course nothing is open now.  They send it to you in a few days.  Don't

remember if there is a charge but it so it is minimal.

 

 

 

I just gave this info (along with other numbers to get) to my new independent

contractor.

 

 

 

On Insurance Receipts I would have:

 

 

 

Name (with the alphabet after it)

 

Mailing Address

 

Phone number  Fax #

 

 

 

License #

 

Tax I.D. #

 

NPI #

 

 

 

I also have a non-par # with Blue Cross of Maryland (don't know if that really

helps the reimbursement process)

 

 

 

My patients never have trouble with these identifying numbers.  I would just

play ball and get the Tax ID and stick it on there.  Less hassle.

 

 

 

I learned about all this when I was in acupuncture school, busy as a one-armed

wall paper hanger.  I started filing my practitioner's receipts with MAMSI. 

They would kick it back - where is this, where is that.  This went on so long I

almost gave up.  Then when I started my business, I stuck all of it on there to

avoid any rejections for this reason.

 

 

 

I am now having to call my personal health insurance co for other

practitioner's receipts I am seeing (also my daughter is seeing an

acupuncturist in another state.)  They are nitpicking things and I have to get

on the phone for, oh I don't know, a half hour maybe an hour to resolve what is

not on the receipts.  I would make it as easy as possible for them.  There is

a lot of money on the table for them.

what are the security/privacy risks of putting the tax id on the form? can

they legally require it for reimbursement on a subform, when the check gets

cut to the practitioner and not to the patient?

You can apply for an EIN

online....https://sa2.www4.irs.gov/modiein/individual/index.jsp

 

I don't think you are going to have much choice in the matter, or that it is

worth working against. Like the others have said, though, I would use an EIN

over your SSN.

They can legally require it. I don't think there are any great risks.  Someone

I met was wanting to do Reikki or something similar in a Vet's office.  The

Vet  was excited about having her work there, but required her to get a Tax ID

before starting.

 

 

 

The risk is putting your soc sec on there.  We used to do that. The tax id

should be fine.

that everyone agrees to provide a tax id, not an ss#, which is apparently

easily applied for online.

 

i'm still not sure why/how they can legally require it on a subform, as they

are not providing income to the practitioner, they are cutting the check to

the patient.

NPI and Tax ID are separate and both are needed for billing purposes. Even

if only billing via a super bill. This is an IRS requirement so that

payments can be tracked for income purposes. Certainly I agree and would not

want to use my social security number as my tax ID, but you can and many do.

Identification number EIN which serve the same purpose.

For a doctor it is not illegal to ask for a SS# but a patient is not

necessarily obligated to give it for purposes of personal privacy. However,

Victory!

I contacted my patient's insur co (Assurant Health) and questioned the need

to require my tax ID# on the subform. I informed the rep that neither state

law in NC nor the IRS requires it, since they are not cutting a check to me,

but rather are reimbursing my patient. I explained that i had privacy and

security concerns about providing the TIN. She said they needed to verify

that i was a legit HC provider. I replied that i had provided my NPI# which

shows my licensure. She spoke with her higher up and they concluded that

they would use a generic tax ID# to process the claim, and would send it

down for payment processing.

 

YES!!

 

I think being armed with the correct info regarding the laws on the issue

made the difference. When i have run up against this before, some years

ago, the rep at blue cross refused to process the claim using a generic

number. i believe they are using the TIN to track the HC provider in their

system.

 

hope that sharing my experience will be helpful to others confronting this

situation.

Glad to hear you got what you wanted, Kath. I wonder though if they will keep

the association in their system, meaning are you going to have to request it be

processed with a generic tax id with each submission. Sounds like you spent a

lot of time on this, and it would be a drag to have to go through each and every

time, no?

this is an issue that has been stuck in my craw as long as i've been in

practice. i knew that there was no legal reason for providing the TIN if

the insur co wasn't paying me income. i was glad to be am to but the matter

to bed. as i now no the laws and recourse (file a complaint with the NCDOI)

if they balk, i only need to make one call to the insur co in the future.

as the issue has no come up for several years, i am not anticipating having

to contact insur co's on a reg basis. the rep indicated that for this

patient they are using the generic id on their internal records. it remains

to be seen if they will continue to bump the claims, but if so, i only need

to make one quick phone call to remind them of their resolution.

 

i just don't like to be bullied and was glad i was able to stand up to the

insur co, and not be pushed around.

Since there is a matter here of taxable income, why would the insurance company

not require the patient's SS on the claim? Was there any mention of this from

the insurance rep? Just curious.

Glad to hear you got what you wanted, Kath. I wonder though if they will keep

the association in their system, meaning are you going to have to request it be

processed with a generic tax id with each submission. Sounds like you spent a

lot of time on this, and it would be a drag to have to go through each and every

time, no?

i just got another call from a different insurer saying they could not

process the patients claim with the subform because it did not have the TIN

that they use for process. i quickly rtn the call, explained that i had

checked with the IRS and the NCDOI (NC dept of insur) and that there is no

legal reason in my state for them to have the TIN to process the claim on

the subform. i went on to explain that for privacy and security reasons i

am unwilling to provide the TIN when no income is being distributed to me,

as it is a security risk to me. I further informed the rep that another

insurer had called about this issue and they had agreed to use a generic TIN

to process the claim. I concluded that this co could also use a generic #

if they need a TIN to process the claim. I was firm and polite. She

immediately agreed to use the generic # and replied that " I'll go ahead and

tell them to process the claim using a generic # " .

 

this was a 2min phone call, including the time spent navigating the

automated answering system and operators.

didn't want the patient's ss#, to my knowledge. i believe they are using

the practitioners TIN to track in their system. or the computer softwear

spits it out if the TIN isn't there and they can't over ride it. that's why

i suggested using the generic TIN.
