I thought this was interesting; anybody on this forum in NM and using injection

therapy or doing drug therapy?

SANTA FE, N.M. - The state Court of Appeals has overturned regulations that

imposed more restrictions on the drugs and substances that can be administered

by doctors of oriental medicine.

The court ruled Thursday that the regulations were improperly adopted last year

by the state Board of Acupuncture and Oriental Medicine.

 

A doctor of oriental medicine from Placitas, Glenn Wilcox, had challenged the

board's regulations, saying they unfairly restricted his practice.

 

The board's regulations focused on the treatment of patients with intravenous

substances and injection therapies. Some substances, such as human growth

hormone, were banned.

 

The regulatory board's chairman did not immediately return a telephone call and

e-mail Friday seeking comment on whether the court ruling will be appealed.

It appears from the full article several things......1) that the State

Board will be attempting to promulgate those restrictive rules in a correct

manner and 2) the rule(s) got thrown out only on technicalities.....NOT on the

issues.

 

No different in Florida when the lawyers attacked our use of the

nomenclature Acupuncture Physician.

 

There were too many individuals and stake holders willing to give it up

based upon a technicality.

 

While the State association openly was agreeing to give it up and actually

helping it along.......just two of us went to the lawyers from the

legislature (House & Senate) and demanded our US Constitutional Commercial Free

Speech rights not be stepped-on....... and through the promulgation of an

advertising rule the Acupuncture Physician nomenclature was put right back

into administrative code with a number of caveats while the other rule was

repealed based upon technicalities.

 

One has to know how to address such issues in the administrative law arena.
