Our use of herbs was technically limited to promoting health, not treating illness, under the old scope. We are now allowed to describe our use of herbs to restore health. This gives us a distinction from health food stores. see the old and new below for details. A. Old Law, under Section 4937 of the Business and Professional Code allows an acupuncturist to perform or prescribe the use of oriental massage, acupressure, breathing techniques, exercise, or nutrition, including the incorporation of drugless substances and herbs as dietary supplements to promote health. B. New Law, SB-341 allows the acupuncturist to " perform or prescribe the use of oriental massage, acupressure, breathing techniques, exercise, heat, cold, magnets, nutrition, diet, herbs, plant, animal, and mineral products, and dietary supplements to promote, maintain, and restore health.
