Patenting herb Fx

I was just searching for information about Wu Mei (Prunus Mume ) and its

antihelminthic properties and Google came up with the following site :

" United States Patent Application 20010000144

Kind Code A1

Keller, Robert H. ; et al. April 5, 2001

Symptomatic relief of allergic reactions "

which seems to be a patent application for a Chinese herb formula with no extra

add ons - just the herbs. Does anyone know whether this is 'allowed'? can you

patent TCM Fx? I know there has been attempts to patent traditional varieties

of plants eg. basmati rice but herb Fx in the TCM pharmacopoeia??!!

I couldn't work out from the site whether the application was

pending/refused/granted. It seems shocking to me.
