Patents containing ban xia also appear to be legal if the supplier can prove no ephedrine alkaloids are present. the rule only bans sources of ephedrine alkaloids. It does not name specific herbs. We still need to fight this with regard to ma haung, but a number of suppliers have had their ban xia products tested for ephedrine alkaloids (contact your supplier). Upon the advice of counsel, these companies are continuing to sell their ban xia products. I always believed there would be a way around the effect of this rule on ban xia since prepared ban xia does not contain ephedrines. I have read the summaries of the legal briefs and if the products are still covered by the manufacturer's product liability and your malpractice insurance, I think it is safe and legal to provide ban xia products if and only if the supplier can provide you copies of COA's for each batch they sell to you. You should keep these COA's on hand in case anyone ever makes a claim against you. Whatever anyone does privately to secure ban xia products through illegal means is of no concern to me personally.
