Evergreen and KPC are not shipping any formulas with ban xia.

Evergreen is shipping formulas with replacements for ban xia.

Ex:

Wen Dan Tang= dan nan xing

Liu jun zi tang= cang zhu

Ban xia hou po tang= xuan fu hua

I will post more of these replacements when I get the info. I think

they should make for interesting discussion.

who is your KPC supplier? there are several different outlets and I believe

they have made different choices about how to adhere to the ban. Golden

flower is selling ban xia in KPC granules as these test ephedrine-free.

However stock is low as the curent shipment has been held at customs.

Whether the FDA releases these products will probably be quite telling. Some

companies are also still selling ma huang containing patents, though I don't

really understand what loophole allows this since if they don't contain

ephedrines, they don't work. A sales rep told me that since her company only

sells to licensed px, it is legal. I respectfully disagree. If it contains

ephedrines and is a dietary supplement, it must be illegal under the current

rule. I have yet to see a rational explanation of how this could be otherwise.

While some lawyers have apparently advised differently, I have to still advise

against buying or selling ma huang containing patents and only buy ban xia

patents and granules that come with a COA. The best bet is to check with your

insurer to see if you are covered and also your state board to see how they

intepret the affect of this rule on your practice. Because if you are not

insured and/or your state board removes ma huang from your pharmacopeia, it

really doesn't matter what the feds had in mind. Insurers don't take on high

profile risks and a boards main mission is to protect the public, not the

licensees.

I use 4 season herbs as my KPC supplier. I believe they are the

main distributor in the US.
