I have a few questions about the new AAC mal practice.

Under exclusions g. use of x-ray. Does that mean if I order or refer a patient

to get xray or discogram am i not covered?

5. Any injury arising out of the use, administration, or prescription of any

drug or pharmaceutical for the treatment of human beings or arising out of the

performance of any procedure involving the cutting or penetration of human

tissue, other than the penetration of human tissue by needles within the legal

scope of acupuncture practice. First there is not definition of drugs. Are they

going to call herbs drugs if sued? Second, can we use lancets or bleeding

needles, are they covered? this must be stated more clearly.

Under 20. any other intentional tort (even if such activities are related to a

Named Insured's of or failure to render professional services); or any injury

from any act or any omission to the extent that such injury is not attributable

to the rendering or failure to render Professional Services. Does this cover

failure to refer, late diagnosis of cancer, etc? This is the biggest area of

growth in mal practice.

And lastly No payment of punitive damages (Defense Only). This policy will

provide a defense only, but does not provide any payment of punitive or

exemplary damages. The biggest part of an award can be punitive damages. What is

that about?

 

 

Interestingly i never got my Lloyds policy so i actually never read it but it

looks like it clearly does not cover herbs or supplements. This was an

incredible BO BO of those that supposedly checked it out and endorsed it. It is

clearly there in black and white, at least from the copy of the exclusions that

AAC mailed to everybody. I still do not have a copy of the Lloyds policy even

though i asked for it
