I believe these concerns about malpractice insurance are valid. The

wording is a bit inflammatory, but the source's contact info is

included for those who take exception.

> CRISIS IN ACUPUNCTURE MALPRACTICE INSURANCE

> Dear Colleagues & Fellow Alumni:

>

> I am writing to inform you, if you don't already know as I didn't

> until very recently, of a crisis in acupuncture malpractice

> insurance. The American Acupuncture Council has a virtual monopoly on

> all coverage for licensed acupuncturists in the country, having

> bought out the policies of nearly all their major competitors. If you

> haven't read the fine print or assumed that the coverage was the same

> as your previous carrier (as I did), then you probably don't know

> their exemptions to liability. An astute colleague of mine brought to

> my attention that under Part V. Exclusions to coverage for which

> there will be " NO Defense or Payment of Damages " is listed " Obstetrics

> and Gynecology, including the delivery of babies, or care of newborn

> infants until they are fourteen (14) days old. "

>

> THE PROBLEM

>

> Do you treat menstrual pain? infertility? 90% of my practice is just

> that and more, including labor induction, turning of breech

> presentation, threatened miscarriage, fibroids, etc. etc.

>

> Scott Danahy Nalon, a broker for this policy, will tell you that they

> only mean Western Obstetrical or gynecological care, and that we can

> still treat syndromes under our scope of practice. I consulted a

> lawyer who specializes in insurance, and she said that the exclusion

> as written is essentially NO protection for us.

>

> WHAT YOU CAN DO

>

> Option 1: Don't treat ANY Gynecology or Obstetrics. This may be a

> viable alternative, but for most practitioners I know, this is NO

> option for the patients who seek our care. The insurance company then

> decides who gets access and who doesn't.

>

> Option 2: Don't carry Malpractice Insurance and practice risk

> management. Also, not a realistic option as one can never predict who

> may be litigenous and many states may require that you do carry

> malpractice.

>

> Option 3: WRITE, FAX, PHONE the American Acupuncture Council and

> DEMAND that this policy be amended to include more specific language

> that will appropriate protect you, the practitioner. Otherwise, you

> are throwing away $1000 a year for nothing.

>

> I have already been in contact with the Lead Attorney at the AAC and

> we are in a continuing dialogue about this issue, but the point will

> be better made if we ALL support this change.  They have been nothing

> less than helpful so far in listening to my requests, so please be

> kind.

>

> PLEASE FORWARD THIS EMAIL TO ALL COLLEAGUES, ALUMNI, PROFESSIONAL

> ORGANIZATIONS, FACULTY, STUDENTS AND STATE AGENCIES AS THERE IS POWER

> IN NUMBERS.

>

> Write to: Michael J. Schroeder, Esq., General Counsel and

> Vice-President, American Acupuncture Council, 1851 E. First Street,

> Suite 1160, Santa Ana, CA  92705

>

> Fax (Even Better!) 714-571-1863 Attention: Michael J. Schroeder,

> I have found only one other Company that will provide Professional

> Liability Insurance in New York without the limitation of the AAC
