Some bills in CA. Several are direct responses to the LHC report.

 

 

Senate Bill 356 (SB-356) was introduced last week by Senator Richard

Alarcon (District 20--San Fernando Valley). This is our vehicle for

cleaning up some " grey areas " in the scope of practice for

acupuncturists. The current version of the bill adds a definition of

" Oriental massage " which is in the current scope but is undefined. Our

bill would define " Oriental massage " and make clear that it includes

" myofascial release " and " manual therapy. " This legislation will make

it easier for L.Ac.'s to bill insurance for these procedures. We are

working with Senator Alarcon to address a couple of other undefined or

poorly-defined aspects of the profession's scope. We'll let you know

Assembly Bill 1549 (AB-1549) was introduced this week by Assemblymember

Paul Koretz (District 42--West Hollywood). This bill is aimed at

improving the status of acupuncturists within the Work Comp system.

This bill would permit the Administrative Director of the Division of

Workers' Compensation to appoint acupuncturists as qualified medical

evaluators (QME), would allow acupuncturists to perform disability

ratings within the Work Comp system, and would permit acupuncturists

and certain other health care practitioners to enter into contracts

with the Administrative Director to be independent medical reviewers

(IMR). This bill would eliminate discrimination against acupuncturists

AB-1113 (Scope of Practice--Diagnostic Authority): This bill would

include in the definition of acupuncture the diagnosis of a person for

the purpose of providing acupuncture treatment. The bill would also

authorize a licensee to diagnose for the use of performing or

prescribing the use of oriental massage, acupressure, breathing

techniques, exercise, heat, cold, magnets, nutrition, diet, herbs,

plant, animal, and mineral products, and dietary supplements to

AB-1114 (Continuing Education Requirements): This bill would require a

Licensed Acupuncturist to complete 50 hours of continuing education

every two years. This would be an increase from the current requirement

of 30 hours every two years. The bill would require five of the hours

of continuing education to be dedicated to public health and public

AB-1115 (Acupuncture Assistants): This bill would create the position

called " acupuncture assistant " and define the scope of services that an

acupuncture assistant is authorized to perform. The bill would require

the board to adopt and administer regulations establishing standards

for acupuncture supportive services that may be performed by an
