> Joint Committee Recommends

> Elimination of Acupuncture Board

>

> On Tuesday, April 12, 2005, the Joint Committee on Boards,

> Commissions, and Consumer Protection--chaired by Senator Liz

> Figueroa--voted to recommend the elimination of the California

> Acupuncture Board. In a " vote only " meeting, the Joint Committee

> approved the committee staff recommendations outlined below. The vote

> of the Committee members were as follows:

> • IN FAVOR: Figueroa, Aanestad, McLeod, and Spitzer;

> • OPPOSED: Koretz; and

> • ABSTAINED: Vincent.

>

> The meeting and vote were conducted without any opportunity for public

> comment or testimony by stakeholders.

>

> In summary, the Joint Committee has recommended that:

> 1. The Acupuncture Board should be " sunsetted " and its functions

> and duties be transferred to the Department of Consumer Affairs; and

> 2. The scope of practice for Licensed Acupuncturists be amended " to

> clarify that licensed [sic] Acupuncturists have the authority to

> diagnose within their scope of practice. "

>

> Currently, these are recommendations only. Both of these Committee

> recommendations would need to be put into bill form and be approved by

> the state legislature and by the governor before they would take

> effect. As of this AIMS eNews Bulletin, no bill language has been

> proposed, so we have minimal indication of where the legislature will

> be going with this issue.

>

> AIMS does not believe that the transfer of the Acupuncture Board's

> duties into a Department of Consumer Affairs bureau is in the best

> interest of either consumers or the profession. We are and will be

> working to prevent the implementation of this recommendation.

>

> As mentioned in the previous update, the issue of diagnostic

> authority is currently being addressed by AB 1113, a bill authored by

> Assembly Speaker pro Tempore Leeland Yee. AIMS is working with Dr.

> Yee's office to ensure this bill contains the best possible language.

> your voice needs to be heard on this and other critical issues facing

> the profession.
