Howdy y'all,

 

thats the 'other' hemp. the illegal one. it is used to reduce the

Some clarification on this .. its too easy to become confused.

 

Hemp is Cannabis .. period. Matters not which of the two primary varieties

we are referring to .. those varieties are:

 

1. Cannabis sativa L. subspecies sativa, var. sativa

2. Cannabis sativa L. subspecies indica

 

Number 1 is the variety most often grown for industrial use and Number 2 is

the variety grown for medicinal or recreational use. Number 2 has poor

fiber quality so its not as useful for industrial purposes as is Number 1 ..

however .. the main botanical difference between the two is the amount of

Tetrahydrocannabinol (THC) in the plant. The main legal difference in the

two is negligible because BOTH will have some traces of THC .. the

difference being that Number 1 will have minute traces in the range of 0.3%

or below and Number 2 will have percentages ranging from 7% to 20% or more.

 

In the civilian world it is not illegal to possess Hemp .. it is

itechnically llegal to possess THC and if the system wanted to target

someone they could prosecute if even a percentgage of 0.1% was found in a

lab test. As far as I know it is not done .. or at least I have not heard

of it being done. The military system is different .. a trace of THC means

there is THC and possession of THC is illegal. In fact, intent can even be

a basis for prosecution .. like .. one could purchase Oregano thinking it

was Marijuana and even when it tested 0% THC there would still be an offense

... Intent to Possess, etc. When a soldier violates rules that might not be

laid out clearly as state or federal laws .. but are violations of published

directives or orders from the chain of command .. they can be prosecuted

under Article 134 of the Uniform Code of Military Justice .. what some call

the Catch All article of the UCMJ.

 

Unless the laws have changed since I got out of the system .. there is no

civilian law prohibiting USE of THC .. there is a law prohibiting POSSESSION

of THC. How one can use without possessing is another matter. ;-) The

reasons for this law are not as strange as they might sound .. because the

original law did not prohibit Possession alone .. it prohibited Possession

of UNTAXED THC .. and there was a time when the government printed Tax

Stamps for Marijuana .. they were just never issued .. as far as I know that

law is still on the books and not a single tax stamp has ever been issued.

 

Alongside the road in Nebraska .. and all over the boon docks and training

areas at Ft. Riley, KS .. one can find a lot of wild growing Hemp

... Type Number 1 .. and there have been young, dumb troops caught trying to

stash it .. even though they would need a great imagination to get a high

from those plants. In order to keep troops from getting their butts in a

bind the military has prohibited possession of these plants regardless of

the amount on THC. Again, its for the protection of the troops and to

avoid costly prosecution.

 

There is no question that there are valid uses for the Number 1 type Hemp

but there are also valid uses for many other things that law enforcement can

bust us on .. like Opium and Alcohol.
