I read an advertisement where an acupuncturist claims the ability to cure my disease. Is this legal? A. No. Pursuant to California Code of Regulations, Title 16, section 1399.451(b) it is improper for acupuncturists to disseminate any advertising which represents in any manner that they can cure any type of disease, condition or symptom. Hardly anyone claims to cure anything even the big dogs just quote percent chance. In reading the recent commentary it sounds like some people have cure and diagnosis confused or are using them interchangeably. Maintenance like a chiropractor, amelioration of symptoms like an MD, or... (dare I say it?) cure? Oh, I get it--we develop a differential diagnosis, determine the pattern, and then refer the patient to those whose specialty is treating symptoms, right? : Our colleagues the MDs, DOs and DCs. Is that it? We diagnose and they cure? Come on Geoff, get real. Of course we can't claim to treat any disease and that's what insurance codes are all about, aren't they: symptoms! Do we treat patients with diabetes or cancer and help them (even maybe cure them?) yes. Do we treat heart, liver and kidney disease (even maybe cure them?) yes. Can we tell prospective patients that we can maybe cure them, explicitly? Absolutely not! But as ludicrous as that is, it's the way the law is right now. You want to get paid? you list the appropriate code. You want to stay out of trouble, speak in double talk and round about riddles.
