I have studied with practitioners of British herbalism (in the US), Cherokee herbalism, Ayurveda and American herbalism, all of whom have extremely sophisticated herbal traditions. We ought not to push for legislation that restricts the rights of others to practice. And we ought not to prevent lay people, wise women herbal tradition practitioners or the like from access to herbs for health. Otherwise we will engender backlashes. And besides, doing harm to the health of society from lack of access is a worse problem than can be found by the almost negligible amount of harm done by inappropriate use of herbs.
