Guest guest
If you use Jen-On herb products, you might want to catch up with an FDA recall. If you're leaving their products in their containers, the liability flows to the manufacturer more easily. When I was researching liability insurance recently, I came upon that information, but I don't claim to know all the ins and outs of the legal issues involved. Obviously, the first job is to remove the products from our own shelves, and alert our patients. I'd just offer a replacement (from a different manufacturer) free-of-charge with the news that there " may be " some problems with the Jen-On products. Ethically, I don't know that you made any mistakes (presuming you were selling Jen-On products). We all have to assume that we're being sold safe products, but of course this is not an assumption that we can continue to make for long. Someone recently quoted Ted Kaptchuk (?) saying that we shouldn't buy herbs from anybody we can't sue. I'm leaning in that direction now too. Not that I'm interested in suing anybody, but if someone is suing me, I just assume pass that buck up-stream as is possible. Speaking of passing the buck up-stream, it is the anti-coagulant drug heparin that is the newest adulterated Chinese import that is being (voluntarily) recalled. -al. -- , DAOM Pain is inevitable, suffering is optional. Guest guest
BTW, if someone knows of a recall and then continues to sell/prescribe that product, then they are liable to be sued for negligence, not malpractice. Therefore, if you have malpractice insurance, it would not cover you. Bob
Guest guest
Bob, that is my opinion as well and goes beyond " brand name " it taints the entire formula - specifically - the herbs involved. One's best defense is not to be sue able. meaning be good and trusty will all patients (and their families) or do not have any visible money. (note: I do carry liability insurance) Peace Ed Kasper LAc. & family www.HappyHerbalist.com .........................................
