Proposition 64 will take away the right of private parties to sue corporations for unfair business practices. Since animals do not have legal standing (meaning they do not have the right to sue or be sued), and since district attorneys rarely enforce animal cruelty laws against corporations, concerned individuals and groups need legal standing to sue when corporations break such laws. Proposition 64 would take that right away. The landmark lawsuit filed by the Animal Protection & Rescue League (www.APRL.org) and In Defense of Animals (www.IDAUSA.org) against Sonoma Foie Gras seeking an injunction to stop them from force feeding ducks to the point of organ rupture and death is based on unfair business practices. Similar cases in the future will not be allowed if Proposition 64 passes. Sonoma Foie Gras was so scared by this lawsuit that it neutralized their opposition to SB1520, a bill now waiting to be signed by the governor that will outlaw not only the production but even the sale of foie gras (force fed duck liver) after a phaseout period. Simply put, if you care about animals, get registered to vote and get to the ballot box this November to vote NO on Proposition 64. California's unique unfair business practices statute has already resulted in unprecedented gains in protecting animals from torture and can do a lot more. Much else is at stake too: the environment, endangered species, and other victims of unfair business practices that will no longer be defended in court against greedy people hiding behind a corporate veil.
