Mercy’s trial, which was scheduled to start next Monday, has been postponed until August 6.

The prosecutor, David Alex, informed me today that DeShann Brown’s attorney, Dan Wyde, requested and was granted a First Motion for Continuance. According to Mr. Alex, judges almost always grant a defendant’s First Motion for Continuance.

The 3 ½-month-delay before the new trial date is based on several factors, including the number of other cases before the court—especially cases of defendants already in jail, which are given priority—as well as the schedules of the judge and attorneys. (As you’ll recall, Brown has been out on bail since his arrest. He posted a $250 cash bond after the Court Magistrate reduced the Judge-ordered bail of $50,000 to a mere $2,500.)

Mr. Alex also told me that Brown will make an appearance at the Pretrial hearing on June 8. This is when the court hears pretrial motions. This hearing only lasts about 5 minutes, but it does take place in open court. Spectators can attend. Pretrial hearings are scheduled to start at 9 a.m., but Brown’s hearing could take place at any time during the day. Those who want to attend should plan to be there all day.

Obviously we are all terribly disappointed by this delay. We were all anxious and more than ready for this trial to get underway on Monday, the one-year anniversary of Mercy’s death. Now we’ll have to wait a few more months before we will—hopefully—see justice served for our sweet Mercy.
