DALLAS (AP) -- A federal judge has thrown out a federal testing program to

detect salmonella contamination in ground beef processing plants, saying it does

not fairly evaluate whether a plant is sanitary.

U.S. District Judge Joe Fish agreed Thursday with arguments from Supreme Beef

Inc. that the Agriculture Department exceeded its authority by pulling

inspectors from the Dallas plant -- effectively shutting it down -- after the

plant failed tougher salmonella inspection standards.

USDA officials said that the testing program ensures raw ground beef is safe for

consumers and that they the ruling would be appealed.

A federal judge in Texas undermined the safety of the nation's food supply

yesterday by denying the government's authority to enforce critical regulations

setting limits on the amount of harmful bacteria in ground beef sold to the

public.
