In-N-Out Burger Settles With Girl Who Fell Gravely Ill With E. Coli

SANTA ANA, Calif. -- A Palo Alto woman who sued In-N-Out Burger after her

daughter became ill with the E. coli bacteria said the lawsuit has been

settled out of court. According to the suit, Cayley Bowles, now 13, required

multiple blood transfusions and 17 days of kidney dialysis after eating at

the Kettleman City In-N-Out Burger near Bakersfield in January 2001. Her

mother, Megan Bowles, says Cayley remains at risk for long-term

complications, including end-stage renal disease. Bowles declined to reveal

terms of the settlement. She had sought $250,000 in damages, plus past and

future medical expenses, and undisclosed punitive damages. She says the suit

was settled last month.

 

The vice president of operations for Irvine-based In-N-Out declined to

comment.
