Guest guest
Paul: The list is being privately archived by Onelist, and I also had someone else inquire about archiving. However, there is at least one list member who is concerned about copyright infringement matters. I mentioned this to the other " potential archiver " , and this is what she told me: ***As far as copyright infringement, I've looked into the subject myself (for obvious reasons) and everything I read and hear tells me that recipes themselves are public domain (the measures and ingredients, plus the basic directions as they're just in standard format). What *is* copyrighted is any commentary that's added -- history, specific comments by the author, etc. And I think there are rules as to posting an *entire* collection of recipes, like an entire cookbook. I'm guessing CL might have had a right to be upset about infringement if the recipes included comments, and perhaps also if this person posed *every* recipe from *every* issue. That's my understanding, at any rate.*** I, myself, am not too concerned about the copyright matters; however, if any other list members do have concerns, please let me know (privately if you wish). My only concern is that I do not want anyone to feel uncomfortable or to *not* post recipes due to their concerns about the copyright matter. If they are comfortable with it, then we could have more archives. What do y'all think?? Karen Paul J. Welty wrote: > " Paul J. Guest guest
I believe the copyright info is correct . . . that the recipe is public domain, but the rest isn't. I'll ask around, though, and see if I find anything contradictory. When it comes to copyright and other forms of literary theft, Mollie Katzen wrote the book. (Pun not intended, but it's a good one!) She did a very bad thing. As a result, I don't buy her books or recommend them. But that's a personal decision on my part, and I don't mean it to reflect on anyone else at all. (A mild hypocritical thing: I have used her recipes, so go figger.) But back to the archives . . . As listowner, are you the only one who can access it, Karen? Or can any of us climb in and wander around? (Sorry if I missed this in earlier posts.) ---Debby
Guest guest
Thanks, Debby! That is my understanding about copyright matters too. Heck, I'm a paralegal and know little to nothing about it -- but if you get hurt (hope not), call me! Anyway, I know that your most favorite person in the world, Martha Stewart, has had many people *try* to sue her for copyright infringement for outright including recipes from *their* books in *her* books, but they were never successful for the very reasons we have been discussing. At the same time, I know that someone used to include all of the recipes from each issue of Cooking Light on their website in *Mastercook* format. They were giving the magazine credit and were only posting them as a favor to " Mastercookers " , so they could easily import the recipes into their program; however, the Cooking Light people demanded that they stop doing this, so they did. In this case though, the person was including every recipe from the magazine. The copyright thing is really not a big concern of mine; however, as I explained, I don't want anyone on the list to be incomfortable about posting any recipes and I certainly don't want to discourage anyone from doing so. If it helps any, I have been posting recipes on lists which are also included on several websites for several years now, and have never had a problem at all -- other than one weirdo who attacked me for including cheese, etc. in recipes. Brenda and Pat may be able to shed some more light on this issue. What do y'all think? The archives for this list are *private*, but can be accessed by list rs (but not the general public). Just go to the Onelist site, put in your e-mail address & password, find " Veg-Recipes " and choose " view archives " . The issue with CL might be because they sell cd's of their recipes also.
