Someone - rescue fish from rotting tank on Irving Street?

Hi all,

I'm posting this in the hope that someone out there can go to this restaurant

and rescue fish that are being left to die in a tank; I do not have the

resources to do this myself. The restaurant is the Vietnamese restaurant, Minh

Tri, a neighborhood institution in the Inner Sunset for 17 years. Due to the

economic downturn and fewer people dining out, they closed up and sold the

business a few weeks ago. I've gone in twice to ask if someone is taking care of

the fish in the tank in the back of the store. The tank is visible from the

front window. Both times the staff told me the fish are " fine " . This morning I

see the largest one is just sitting at the top possibly dead (but not floating);

one of the other ones is swimming very slowly. The water has been looking

murkier over the weeks. I don't believe anyone is taking care of these fish. As

far as I know, Animal Care and Control don't rescue fish.

The restaurant is on Irving Street between 6th and 7th Avenues, on the north

side of Irving, right next to the Ten, a Japanese restaurant.

Thanks,

Jan

Jan,

Animal Care & Control should rescue them (though they may refuse), as they are

protected from animal cruelty under CA Penal Code section 597 (animals are

defined as " every dumb animal " in 599b, though I don't believe its application

to fish has been tested in courts). I have contacts there due to my campaign

against the live poultry vendors and will forward the message to them.

I forwarded the information to the top people at Animal Care & Control (and also

a contact as SPCA), and received an email back from Lt. Le-Ellis Brown saying

they will investigate the care and welfare of the fish. That's actually a very

pleasant surprise, but I think they know how persistent I can be... ;) I don't

know what resources, if any, they would have to actually rescue the fish. If I

don't hear the results soon, I'll follow up the the Lt.

The fastest and easiest way is to post in Craigslist describing what type of

fish it is ...

it needs a good home (no it's not an edible fish)

Animal Care might not move fast enough to save this fish. Most fish can live

for a while eating alage. However if the oxygen in the water is overtaken by

too much alage, the fish have to fight for air (oxygen)

Thanks to Andy and to Sunny for responding.

I have not had a chance to pass by the restaurant to see if anything has been

done.

I hope Animal Care and Control has looked into or will look into it. The place

is closed for now, so it's hit or miss finding someone there, and no sign of

when they'll re open or

when someone will be there to even let someone in to rescue the fish.
