Personal experience viz.: Living Foods Tradmarked by Ann Wigmore Institute?

Hi Brenda, Anne, and everyone,

 

From one post by Brenda, the person being sued and whose email address I

provide in this message:

 

My attorneys are working on this case now and have told me that since there

are so many other people using these terms and words and teaching about

living foods that we are in need of emails or letters to support that these

words have become commonplace among us. I would appreciate it so much if you

would send me a letter in support of the fact that hundreds of teachers,

writers, and leaders in this raw and living foods movement use these terms,

including yourself, if you do, and that you do not agree that the Ann

Wigmore people or any one person or group should own the rights to these

words or any similar words or phrases exclusively.

 

If lots of people would simply respond to this request, this lawsuit will

likely crumble and we can all go back to doing ... whatever we were doing.

Otherwise, you'd be amazed at some of the lawsuits over trademarks that have

been won, simply for lack of a vigorous defense.

 

Speaking for myself only, I have heard countless people -- hundreds at the

very least -- use the phrase " living food " , and the plural, " living foods " ,

since I was first exposed to the idea more than nine years ago.

Occasionally, some attempt to use the term to convey a distinction between

" living food " and " raw food " . However, in my own personal experience, most

people use the term very casually and with less precision. For example, some

people express a belief that, because the enzymes in raw foods have not been

destroyed by heating, those foods possess a certain " life force " or " vital

energy " or the like; hence, they are " living foods " . But most people, who

speak in this way, seem to use such expressions in a fairly imprecise

manner, not really grounded in any personal knowledge of whatever science

may underlie such ideas. And far more frequently, I hear people use the

phrase " living food " interchangeably with " raw food " , in other words, very

casually.

PS I would also like to share that I see no purpose in imagining the intent

of the folks behind this lawsuit; making such stuff up serves no

constructive purpose, in my opinion. For example, I do not find these events

fortunate or unfortunate; instead, I simply find them to be events. I prefer

to refrain from judgment and to wait and see how the parties work this out

between them, recognizing that there may be information of which we are all

presently unaware.

Brenda I am very sorry you have encountered the issues you have with the

PR and NM Ann Wigmore Institutes. However, copyrights are copyrights.

BUT, since 5 years passed, during which time the name " Living Foods " was

" open " for use, I am certain GREAT COUNSEL can assist you.

 

It is my belief, given my experience of the NM Ann Wigmore Institute,

which should be closed down by health authorities in my opinion, that

monetary motives are at work. While I cannot speak about the PR

Institute, I can say my experience with the people associated with and

running the NM Institute, have been trying to sell it (to personally

pocket monies), and are of questionable integrity. Again, this is my

personal opinion. Beware. Your counsel must carefully investigate the

persons responsible for this legal action.

 

I find it more than unfortunate that the anyone of the " Living Foods "

community would attack another. Needless to say, I agree also with

Gabriel Cousins. I am certain Brian Clements of the HHI would agree as

well. Perhaps you should consult with him as well. O

I think you should read Jim Carey's open letter about Susan Lavender,

" Director " of the NM Ann Wigmore Institute to better understand my warning.

Enough said. I have made a judgment based on extensive experience with

REPUTABLE living fooders who help not hinder the word. Thank you.
