Guest guest Posted April 27, 2006 Report Share Posted April 27, 2006 Dear friends in India, I am sure that many of you would have read of the ruling against Jallikattu (Tamil Nadu style bullfighting) and cattle (rekla) races by Justice Bhanumathi of the Madurai Bench of the Madras High Court. This is a ground-breaking judgement since courts and successive Governments in Tamil Nadu have refused to entertain cases against these activities under the garb of it being " tradition " . So was sati and child marriage and female foetecide. Justice Bhanumathi's judgement of March was unsuccessfully appealed against before a Bench of the High Court and the appeal was turned down. The learned Judges of the Bench said that as long as the matter was not brought before the Hon'ble Court, they could not say anything. Having been brought to their attention, the expressed their complete disapproval of the activities which were a direct contravention of the Prevention of Cruelty to Animals Act of 1960. Justice Bhanumathi's landmark judgement will help those of us who have to fight such " traditional " cruelties in other States. The judgement makes for fascinating reading - the Learned Judge has quoted from a plethora of sources including Maneka Gandhi's Animal Laws of India; J. Edgar Hoover's study of persons convicted of violent crimes against people which showed that the 'first strike' of these violent people was invariably against animals; other anti-cruelty judgements; etc. For those of you who would like a copy of this judgement to help in your fight against animal cruelty, please contact me and I will be happy to send you the entire judgement by e-mail.
