The April 3, 2007 letter was based on a Board circular, dated January 24, 2007, stating that the allottees should not keep any pets on the campus. The petitioner, D. Mathuram, employed with the Institute of Mental Health, said the letter directed her to remove her pet dog from the flat as it was against TNHB rules and regulations. She was orally informed that her allotment would be cancelled if she failed to remove the dog. Questioning the validity of the letter, she filed a writ petition contending that the original allotment order did not contain any condition prohibiting pets in flats. She maintained that abandoning pet animals and failure to provide them food and shelter would amount to an offence under the provisions of the Prevention of Cruelty to Animals Act. The petitioner said she and her family members, all residing in the Tamil Nadu Government Servants' Quarters at Shanthi Colony in Anna Nagar, were animal lovers. The dog was with them for 14 years.
