federal law restricting resale

I only just heard this in passing and didn't know that it did actually

affect resellers (someone was asking if it would affect

ebay/resellers/etc). For some stuff, I can see why that would be a

good (for the lead, like in toys from China and such) but overall -

it's going to probably also put a damper on folks who sell on Ebay, or

even the local goodwill/salvation army/amvets(and the like maybe they

fall into that as well...?).

This is crazy.

Thanks for the links, I'm going to check them out, since all I heard

was 'hey does anyone know about this new law?' and I hadn't and then

here it was. :)

I don't understand why, but I only included one link, but it came up as

three on the email. Weird.

Some people I have talked to about this have expressed concerns for some

work-at-home moms. (They make cloth diapers and dolls.) They aren't clear

if this would apply to them, and (through the grapevine) the test per item

could be up to $70. The moms can't afford this, and some are planning to

stop selling in February. Or at least selling items in the US.

A friend of mine (she teaches at a Law School) sent me this link:

This is a link to a site where you can post your complaint to the CPSC:

http://www.cpsc.gov/cgibin/info.aspx

I thought it would be relevant here.

I also found this site (which has some good links for explaining in

more detail what this is all about, in the first part )

http://www.fashion-incubator.com/archive/national-bankruptcy-day/

http://www.fashion-incubator.com/archive/national-bankruptcy-day/

There are others, but I didn't want to just post a bunch from that

site But that's only one place that I've found that really goes into

the details of it (I don't know how accurate the info is, as I can't

really find anything other than the button pushing panic type rhetoric

that doesn't get into the actual details other than what's already

been said (not that it's not a bad thing, just I want to know more

than 'you can't sell x anymore' - like what all does that encompass.

Sure I don't want to buy clothing or toys with lead from resale

myself, but not everything has it in there - and forcing individuals

or small businesses or non-profits out of business for reselling if

everything HAS to have a certificate that it has been tested and is

lead free will be a huge detriment to small business owners who make a

living or supplement their income off of this stuff)

Ok.

I'm off to read and search for more info about this.

Yet here's another topic Rollye James was talking about just the other night. I

don't listen to her show much; perhaps I should more!

She's a lawyer and stated that this law applies to everyone; many thrift stores

etc. are already taking basically ALL of their resale/donate kids' items off the

shelves to comply with the law. It does include ebay sellers, etc.  It is part

of the law of unintended consequences- lawmakers intended to do a good thing

(get lead out of kids' products) and are affecting millions of small business

people etc. in the process. This also includes garage sales, by the way, as

there is no exemption in the law for that, either. Rollye was encouraging

everyone to contact their local congresspeople; they can actually change this

law fairly easily by amending it.
