Sir,

 

Sub:Conduct of a 'sponsored Pakalppooram ' in Kottayam on 23-03-2009

violating the Central Acts , Rules and Court orders regarding.

 

Ref: (1)My letter dated March 13 addressed to the S.P.Kottayam.

 

(2)Letter from the Secretary,AWBI -in reply to to the Kottayam

District Collector's letter H5-132069 /09 dated 19-03 2009 - clarifying

that the elephant owners have not obtained the mandatory Registration

Certificates from the AWBI

 

(3)Reports from the various media that " Josco Pooram " will be held as

per schedule.

 

(4)Case no.WP© No.37717/2008 being heard in the Hon:High Court of

Kerala -filed by the Elephant owners of Kerala Vs AWBI etc.to nullify the

Central Performing Animals Registration Rules 2001

 

 

I request you to immediately intervene and stop the public exhibition and

performance of the large number of elephants to be assembled at

'Thirunakkara Maidan', Kottayam promoted and sponsored by a local Jewelley

owner where none of the elephants were registered with the AWBI under the

Union Ministry of Environment & Forests

 

While a pending case is being heard in the Hon: High Court of Kerala filed

by the elephant owners to squash an entire set of existing Rules passed by

the Parliament,it would be highly improper that an illegal and unregistered

assembly of elephants is allowed under your jurisdiction-that too at a time

when the Code of Conduct Rules have come into existence in connection with

the Parliament Elections 2009.

Let me humbly remind you that it will definitely send out encouraging

signals to the would be law-breakers and people with petty politcal and

monetary interests.

 

As per provisions 24,25 & 26 of Chapter 5 of the P.C.A. Act1960, I request

you to consider this as a petition to stop the performance, exhibition

and illegal assembly of the elephants referred.

 

I reqest you for the speedy and just execution of the law of the land.
