It has also directed the authorities that the order should be implemented without further delay. The petition challenging the decision of Pathanamthitta District Collector, who denied permission for conducting the cattle race, was filed by Anandappally Karshaka Samithi. Pathanamthitta District Collector, Animal Welfare Board of India and Society for Prevention of Cruelty to Animals(SPCA) also got impleaded in the case. Justice V Giri, in the judgment, said that the nature of overdriving and beating animals were indispensable in cattle race. The court said that it did not find any reasons to grant any relief to the petitioners. “The Maramadi competition is already banned,” the court said. “The Pathanamthitta District Collector and SP should ensure that there is no bullock race or any other performance by animals in violation of Animal Welfare Board of India norms. “No Maramadi competition shall be permitted by the petitioner or any other body claiming the same credential or desirous of holding such competitions,” the court said. The SPCA, which got impleaded in the case, along with the affidavit, had produced a communication issued by AWBI to Pathanamthitta District Collector stating that bullock race cannot be permitted as it was against Performing Animals(Re gistration) Rules-2001 and such cruelty to animals are prohibited under Section 11(1)(a) of the Prevention of Cruelty to Animals Act 1960. Guest guest Posted August 14, 2009 Report Share Posted August 14, 2009 With the AWBI becoming increasingly pro-active, we can expect more such rulings giving animals the protection they are entitles to under the law. Individual AWOs like the Idduki SPCA and animal people are now being encouraged by the Board's attitude to do more. While an odd judgement like in jallikattu may be bad in law in my opinion, India has some of the best animal protection laws anywhere. Alas, like for most legislation in the country, enforcement and corruption are the largest problems. S.
