Additional Chief Metropolitan Magistrate Sunil Chaudhary passed the order to set them free in a natural habitat after being provided with required medical treatment. The police, in an application, sought permission to release 48 birds as seven of them died yesterday while being produced in the court. The investigating officer said there was no government facility for providing treatment to the birds in the national capital except one Jain hospital here. Counsel for two accused Mohsin Ali and Shafiq also submitted that he had no objection if these birds were ordered to be released by the court. He, however, denied these birds were recovered from the accused. Among the birds ordered to be released are 28 black headed munias, 14 red spotted munias, five rose ringed parakeets and one rose ringed parakeet (blue). Meanwhile the court fixed August 27 as the date for final arguments against the two accused in the case relating violations of the Wildlife Protection Act. Ali was found in possession of 100 black headed munias, 50 zebra finches, four parakeets while Shafiq had kept 100 black headed munias, 20 zebra finches, two weaver birds, 100 red munias and 40 love birds and one white cockatoo at a place in the old city area here on August one, 2004.
