This was after the Thane unit of Society for the Prevention of Cruelty to Animals (SPCA) registered a complaint against them under the IPC [Mumbai Mirror, September 5 issue]. Earlier, a resident of Nalla Sopara, Kavita Sharma had claimed she had adopted the dog which was a stray. She had earlier registered a complaint against the men under the Criminal Procedure Code (CrPC). The four were then produced before the Vasai Tehsildar and released on a personal bond of Rs 3,000 each. According to Sharma, she learnt from her friends mother that on August 23, the four accused, Punit Singh and his brother Manish, Vishal alias Jude DSouza and Nigel Sumitra, had rendered the dog unconscious and brought it to the lobby of her building. Her friends mother later saw them running away with the dog. Shakuntala Mazumdar, president SPCA, Thane, said, We were shocked after reading the Mirror story that the Nalla Sopara cops did not register an FIR. The SPCA did not agree with the polices excuse that the youths had committed the offence for the first time, and if an FIR was registered, their careers would be spoilt. So we decided to register the complaint. As per rules, the Nalla Sopara police should have registered a case and not let the four be released on a bond of a mere Rs 3,000 each. API Sudhir Wagh said the dogs body could be exhumed. But as it would be ridden with maggots, it was not done, said Mazumdar. We only wanted the police to register an FIR against the four youths, as they had been cruel to the animal, said Mazumdar. We have registered a case under Section 428 (mischief by killing or maiming an animal) of the IPC and Sections 11 (a), (1) of the Prevention of Cruelty to Animals Act 1960, said API Wagh. SPCA just wants to give a message to society that no one should take the law into their hands and kill an innocent animal. If the four men had a problem with the animal, there are appropriate agencies like the civic council or the SPCA, instead of just killing it, said Mazumdar. -- Thank you for your compassion !
