Sir,

Despite the existence of the Central Performing Animals Registration Rules

2001 and the landmark judgment from the Hon.High Court of Kerala on 12th

August 2009 insisting on the production of Registration Certificates for all

performing animals, the elephant mafia in Kerala still bring the sick and

ailing elephants before the public for exhibition and entertainment.

We have been constantly trying to bring these people before the law so that

the necessary and mandatory above certificate be produced by them before the

public exhibition of elephants in Kerala.

If someone could approach the Hon.Supreme Court of India and get orders for

the strict implementation of the Performing Animals Registration Rules 2001

all over the nation,I feel such crimes will come to a stop.

Though using elephants for commercial purposes and sale and transfer of

them are punishable offences and banned in the Central Wildlife Protection

Act1972, no such criminals were punished by the Kerala Courts so far!.Every

year especially during the temple festival season in Kerala a large number

of elephants are illegally trafficked to Kerala.

In every District in Kerala there is an 'Elephant Squad' armed with

imported tranquiliser guns and special vehicles under the Animal Husbandry

Department designated to shoot elephants when they are in 'musth'or turn

'rogue'.The shooters though from the State Animal Husbandry Department;

get a hefty amount of money from the elephant owners and most of these

'killer shooters' do not have basic knowledge and training in the

tranquilising protocol. Though elepant is a wild animal and any deliberate

harm inflicted upon it invites penal punishments none of these 'shooters'

get punished for such acts.

Let me request you to save the 1000 plus captive elephants in Kerala from

further pain and suffering and ensure that all the owners fall in line in

obtaining the certificates as per the Performing Animals Registration rules

2001.

Please read the following news atories that appeared in the press.

ALAPPUZHA: The body of the tusker, which went berserk and killed one person

at Nakkada on Thursday, was found from the Pamba river near Shonapady of

Pulikeezhu police station limits in Pathanamthitta on Friday morning.

The elephant which ran amok from Budhanoor grama panchayat in Mannar had

created panic and killed 56-year-old Sasidharan of Anjilimootil House,

Pandanadu, Nakkada, and injured his mother Saradha.

Though tranquillisers were shot by veterinary doctors, the elephant had

disappeared in the river on Thursday night.

According to the police, owing to the effect of the tranquillisers, the elephant

drowned in the river.

*Elephant drowned in the Pampa *

Staff Reporter

------------------------------

*

It had received a tranquilliser shot after turning violent.

*

------------------------------

PATHANAMTHITTA: The carcass of a 34-year-old temple elephant, Sivasankaran,

which ran amok and killed a 56-year-old man, Sasidharan, at Nakkada in

Alappuzha district on Thursday afternoon, was found in the Pampa, near

Valanjavattom Shonappady, in Thiruvalla taluk on Friday.

The elephant belonging to the Travancore Devaswom Board was with the

Madhathilkavu Bhagvathy temple at Kunnamthanam, near Thiruvalla.

The elephant, which had created terror at Nakkada, Parumala and Pandanad

villages on the banks of the Pampa on Thursday afternoon, was given a

tranquilliser shot by an elephant squad from Pathanamthitta.

The pachyderm that entered the river at Nakkada later in the evening was

missing throughout the night. A police party had conducted a search in the

Pampa on a speed boat on Thursday night and the carcass was found floating

in the river near Valanjavattom around 9 a.m. on Friday.

The police and a team of Fire and Rescue Services reached the spot and

lifted the carcass using a crane.

The carcass was taken to the Devaswom Board College premises at Parumala for

post-mortem and cremation.

The Thrissur-based Elephant Lovers Association has alleged indifference on

the part of the authorities towards illegal public exhibition of captive

animals, leading to such kind of untoward incidents in different parts of

the State.

In a statement issued here on Friday, association secretary V.K.

Venkitachalam said the authorities should ensure that only animals

registered as per the Performing Animals Registration Rules should be

permitted to make a public performance.

He alleged that the tranquilliser shot had led to the drowning of the

elephant and stern action should be taken against the squad members.
