FIR AGAINST OWNER OF WESTERN CIRCUS AT GURGAON FOR VIOLATION OF THE PREVENTION OF CRUELTY TO ANIMALS ACT, 1960 / WILDLIFE PROTECTION ACT, 1972 READ WITH CITES AND Guidelines for care and management of captive elephants

Dear Sir,

It is humbly submitted that:

* Western Circus performing at Gaushala Ground under Civil Lines Police

Station.

* All performing animals like Elephants, dogs, horses and Macaws (4 red

color with out ownership - illegally imported) are not registered with the

Animal Welfare Board of India under section 38 of the Prevention of Cruelty

to Animals Act, 1960.

* Dogs performed through fire ring, which is banned and the violation of the

section 3 and 11 of the Prevention of Cruelty to Animals Act, 1960.

* There are five performing horses but this circus don't have ownership of

four horses, the same situation with the dogs and these animals are

illegally kept by this circus owner.

* Elephants are not kept as per guidelines of the Central Zoo Authority of

India, violation of these instructions along with the violation of the

Guidelines for care and management of captive elephants, issued by the

Ministry of Environment & Forests bearing No 9-5/2003-PE dated 8-1-08.

* Animals are brought Gurgaon under very heavy stress, pain and injury

because transport vehicles are not as per ISI specification.

* As per section 96-97 of the cattle transport rule, 1978 amended in 2001,

Animal Welfare Board of India chairman certificate required before

transportation of all animals, violations of these sections as well.

* Criminal conspiracy against animals, read with 120-B of IPC.

The International Organization for Animal Protection - OIPA in India

requested you to to please direct SHO, Civil Lines to lodge an FIR against

the owner of this Western Circus Akbar Hussain for the violation of the said

law of the land read with 120-B IPC and Wild Life Protection Act, 1972. It

is further requested that all animals may kindly be seized and kept in the

infirmaries set up under section 35 of the Prevention of Cruelty to Animals

Act, 1960 during court trial and this circus owner may not be allowed to

shift animals from Gurgaon being an case property.

I have just been informed telephonically by OIPA Cheif in India Mr. Naresh

Kadyan to inform you that Western Circus is currently performing in Gurgaon

and has been using following animals without ownership certificates and

permission from the AWBI.

 

5 Horses.

2 Elephants

15 Dogs

6 macaws.

 

Hence, you are requested to look into the matter urgently and take necessary

action.
